- Section 14 guarantees the right to privacy, which includes protection against the unlawful collection of personal information.
Section 12(2) protects the right to bodily and psychological integrity, including the right to make decisions concerning one’s body.

However, these rights are not absolute and can be limited under Section 36(the limitations clause) if it is reasonable and justifiable in an open and democratic society.
Thus, Cwecwe's right to justice must also be considered. If the DNA sample is crucial to proving her case, the refusal by the principal could hinder her access to justice, which is a fundamental right in terms Section 34 of the Constitution. The court may need to weigh the principal's rights against Cwecwe's right to a fair trial and the access of justice

The principal's rights are not being violated if the request for a DNA sample is made in accordance with the law( section 36D of Criminal Procedure Act (as amended by the Criminal Law Forensic Procedures and is deemed reasonable and justifiable. However, if the refusal to provide a DNA sample obstructs justice for Cwecwe, the court may need to intervene, potentially drawing adverse inferences against the principal.
