I believe this is dog should be put down, for protecting his property. The dog is simply defending his area, and if the intruder had not have been there in the middle of the night, the dog would not have done this. The offender should be the one punished. We get dogs to protect our family and house, as well as for companionship, and by putting this dog to sleep, not only will you be killing a family member, your also allowing the unsavoury in our communities to have access to do god knows what. If someone enters another person's property unlawfully and without permission, surely they forfeit the right to make a complaint against a family pet defending the property? What punishment has been issued to the trespasser, since they've admitted via the accusation against the dog that they actually were trespassing?
