Reply to my application for no standing zone, let's see if the vehicles get moved!

Dear Ms Humphreys

Thank you for your emails addressed to Cr Milkovic, raising concerns with vehicles parked near the intersection of Briar Hurst Av / Prospect Hill Dr intersection.

Cr Milkovic has noted your emails and requested I review and respond to the matters you raise therein.

I appreciate the dashcam footage you included, which helped us to understand the scenarios you encountered.

This matter was investigated by Council engineers and fortunately all vehicles were present during the inspection, so they could experience the same situations as per your videos. 

From an engineering perspective the vehicles were parked more than 10 meters from the intersection.  As such, they were not infringing on this space, which is a default road rule (i.e. doesn’t need to be signed).  The purpose of the 10 meter rule is to keep the area immediately adjacent to the intersection clear of obstructions to assist with maintaining adequate sight distance and manoeuvring space at the intersection. 

The presence of the parked vehicles outside of the 10 meters may assist with keeping vehicle speeds low near the intersection.  This results in reducing the risk at this location as the slower speeds provide more time for drivers to react to situations, such as stopping or altering travel path as necessary.   

With the above in mind, we are not proposing any engineering interventions or additional parking restrictions be introduced at this location at this time.

However, it was noted the truck was over 4.5 GVM and the van appeared to be unregistered.  In accordance with the Road Rules, vehicles 4.5 GVM and over are not permitted to park on-street within built-up areas for more than two hours (unless signed otherwise), and unregistered vehicles are not allowed to be ‘stored’ on-street.  Councils Local Laws team are investigating these matters and may take further actions to address this situation as necessary.

Again, thank you for bringing these issues to our attention and I trust the above information assists.

Request for "no standing" zone

Good morning everyone!

Hope you are all well. Just a little update. As council are not (for some reason) permitted to move the vehicles on this intersection i have put in an application to make the highlighted section of Briar Hurst Ave a no standing zone. This corner is a daily hazard especially for the residents at number 4 as they have no visibility when exiting their driveway.  I have submitted dashcam of near misses to the council for consideration.  I would love if any other residents have dashcam or stories to please submit them to council also! If you need contact details please let me know!

Morning all! I emailed again today to see what council are doing about the cars and ongoing mess ,  see below reply:

Hi Sally,

Thanks for this update. I will pass it on to our parking management team to resolve and get back to you.

As for the property itself, we are working with the owner to continue with the slow removal of items from the property.

There’s still about a month left until the timeframe to clean up (or provide an agreed plan to Council) expires. We are yet to hear anything from the owner, other than the assurance that the property will be cleaned up.

As I have mentioned previously, if the deadline is not met, we will seek a decision from the Courts to allow Council to undertake the work. This is not the ideal solution, but it will resolve the matter. This action will also include any vehicles stored on the road as well.

I expect that in a couple of months, we will see some drastic improvements in the area.

Not forgotten!

Hello!!

Just to let you all know that this issue has not been forgotten! Council requested patience to clean up this property and apparently the owner was given 60 days...

I must admit that since the rubbish from the footpath was removed not much has changed but I will keep you updated!

Update from council :

Hi Sally,

 I am pleased to inform you that the items have been removed from the footpath today, and pedestrian access has been reinstated.

  I have also raised the question of the vehicles being stored on the road reserve with Victoria Police to ascertain if they are located in a dangerous location. They have observed the location of the vehicles and have no concerns. That said, we will continue to work with the property owner to remove the vehicles from the road reserve and return them to his property. 

Over the next few weeks, you may start to see skip bins and waste compactors frequenting the property or located on the footpath, which at times, may restrict pedestrian access. These will be utilised to remove the material from the property and will take some time to resolve.

 Again we ask for you and the surrounding residents, patience during this period.
